Neither FRAO nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the Site. The use of these images by you, or anyone else authorised by you, is prohibited unless specifically permitted by these Terms and Conditions or specific permission provided elsewhere on the Site. Any unauthorised use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.6. FRAO has not reviewed all of the sites linked to the Site and is not responsible for the contents of any off-site pages or any other sites linked to the Site. Your linking to any other off-site pages or other sites is at your own risk.

7. Although FRAO may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards, and the like on the Site, FRAO is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information contained within such locations on the Site. You are prohibited from posting or transmitting any unlawful, threatening, libellous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane materials or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law. FRAO will fully cooperate with any law enforcement authorities or court order requesting or directing FRAO to disclose the identity of anyone posting any such information or materials.

Assessments and reports

8. By submitting any contribution including information in respect to a request for a risk assessment to this site, you warrant that

8.1. such contribution is your own original work and that you have the right to make it available to FRAO for all the purposes specified above;

8.2. that the information you have provided is correct accurate and true and that you have complied with all and any information requests provided to you by FRAO;

8.3. you hereby Indemnify FRAO against all legal fees, damages and other expenses that may be incurred by FRAO as a result of your breach of the above warranty; and agree to waive any moral rights in your contribution for the purposes of its submission to and publication on the FRAO site and the other purposes specified above, and/or waive any claims or rights you may have arising from any statements or comments made to you following any risk assessment.

8.4. You accept and agree the disclaimers contained in these Terms and as set out in the reports provided.

9. The report will be provided subject to the disclaimers set out in these Terms and within the report itself and the findings and statements contained within it will only be valid for one year from the date the online assessment is carried out unless satisfactory updates can been completed.

10.If a basic package is selected a report will be accessible online and you will be provided with a unique password and username that will allow you for one year to accessand edit the report.

11. In addition the report will be held in pdf format which may be saved and printed and which FRAO will email to you after assessment completion and addendum

12. Addendums to the report may be made during the year in order to show the audit of the action plan.

13. The assessment contained within the report is dependent on the specific information provided by you. Any subsequent change to the information provided must be notified to FRAO.

14. An assessment is not transferable and any material changes to site may require a new assessment.

Online Sales

17. The Reports are prepared and provided by FRAO. The Products are normally sold through the FRAO shop.

18. Credit or debit card details are used for processing payment only. We use a third party card processor for the processing of payments received through this website.

19. Our site uses SSL encryption. Your browser will go into secure mode on any form where you are required to input your credit/debit card or bank account details. This means that all your details are encrypted and transmitted securely to us. You can check if you are in a secure environment by looking for either a locked padlock icon or key in the grey bar at the bottom of your browser.

20. When you place an order with us you will receive an automatic confirmation email. Your order represents an offer to us to purchase a product or service which is accepted by us when we send an email confirmation to you of the dispatch of such product

21. If you have chosen our monthly or yearly plans these payment will be taken automatically on the corresponding date for each period until cancelled.

22. The minimum period for monthly subscriptions is 12 months. Cancellation before this period will be charged a £150 administartion fee.

23. While all reasonable care is taken to protect the confidentiality of your card and personal details, FRAO cannot be held liable if, through no fault of our own, these details are intercepted and used by an unauthorised third party.

24. Delivery will be made to your billing address or such other address specified by you at the time of ordering. The FRAO reports will be downloaded in a PDF format.

25. Orders can only be delivered to most addresses within the UK. For enquiries on this or in respect of international deliveries outside the UK (including Channel Islands) please contact sales@FRAO.co.uk

Orders must be placed before 12pm the previous working day

Please note that working days exclude Saturdays, Sundays and bank holidays. Any delivery timescales are indicative only and do not constitute binding obligations on us.

For security reasons all parcels must be signed for on receipt.

26. If you take delivery of a product which is damaged, defective or incorrect you can return the item(s) to us within 30 days of receipt for exchange. Please note that you will be responsible for the cost of returning the items unless we delivered the item to you in error, or if the item is damaged or defective. Customers in the European Union also have a right to withdraw from the purchase of an item within 7 working days of the day of order. This right of withdrawal applies to all products If you need to cancel, return or replace a product or cancel a risk assessment, for whatever reason, you should first contact customerservice@FRAO. For your protection we recommend that you use a recorded delivery service when returning items to us.

27. FRAO will only provide refunds in respect to a cancelled request for an online assessment in it’s absolute discretion.

28. All prices Exclude VAT (where applicable). Unless otherwise stated there are no delivery charges.

30. FRAO may at any time revise these Terms and Conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the current Terms and Conditions to which you are bound.

31. If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from this clause and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.

32. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
